II - CANCELLATION - WITHDRAWAL - CHANGES
1. The travel agency may cancel the package tour contract due to reasons that prevent the start or continuation of the trip, such as the failure to form the required number of definite registrations and/or force majeure events. In this case, the consumer has no right to compensation. The travel agency is obliged to notify participants of the cancellation of the tour and to refund all fees received from the consumer within 14 days. Even if the visa process has been completed, visa fees will not be refunded in the event of cancellation of the relevant tour. Consumers purchasing package tours are responsible for their own visa obligations.
2. A - In domestic hotel sales, if the consumer terminates the reservation/contract up to 30 days before the start of the service, the entire reservation fee paid will be refunded, excluding taxes, duties, and similar legal obligations that must be paid.
B- In domestic hotel sales, if the consumer cancels the reservation/contract 29-15 days before the start of the service, they accept, declare, and undertake to pay 35% of the trip fee to the travel agency, and if they cancel less than 14 days before, the full amount. If the consumer cancels the reservation/contract 29 days or less before the start of the trip, excluding force majeure, they accept, declare, and undertake to pay the full trip fee to the travel agency. Date change requests made by the consumer are considered cancellations, and will be notified in writing by the consumer, taking into account the periods specified in the relevant articles. For promotional package tour sales (such as package tours titled early booking discount and promotion), for any cancellations occurring from the reservation date for any reason, the full trip fee is forfeited and no refund is made. Name change, date change, and transfer requests are not accepted. In this case, the consumer accepts and undertakes to pay the full trip fee to the travel agency as a cancellation penalty.
D- For cruise tours: if the consumer cancels the reservation/contract up to 90 days before the start of the service, they accept, declare, and undertake to pay 10% of the trip fee; if they cancel 89-60 days before, 30% of the trip fee; if they cancel 59-31 days before, 50% of the trip fee; if they cancel 30-16 days before, 75% of the trip fee; and if they cancel less than 15 days before, the full trip fee to the travel agency.

If the consumer, despite exercising all due care, submits a termination notice less than thirty days before the start of the package tour due to a situation or force majeure that they could not foresee or prevent, provided they submit documentation regarding that situation, the amount paid by the consumer will be refunded to them within 14 days without any deduction, except for taxes, duties, and similar legal obligations that must be paid, and amounts paid to third parties that can be documented and are not refundable.
F- In all domestic and international service cancellations, fee refunds are made according to the payment methods used by consumers. Payments made in foreign currency are refunded in foreign currency, and payments made in TL are refunded in TL according to the payment methods. The consumer cannot request an exchange rate difference in fee refunds.
G- Visa Application and Visa Denial
The consumer accepts, declares, and undertakes that obtaining a visa for international travel is entirely at the discretion of the relevant country's consulate, that Bluemaxx Travel acts only as an intermediary in visa procedures, and that it bears no responsibility whatsoever for visas not being obtained, being delayed, or being denied.
If the consumer cannot obtain a visa, cannot attend a visa appointment, the visa result is not finalized by the travel date, or the visa is denied for any reason; even if this results in the consumer being unable to join the trip, this situation will be accepted as a consumer-initiated cancellation.
In this context;
Consulate fees, service fees, and amounts paid to third parties for airline tickets, accommodation, insurance, and similar costs that are non-refundable under the visa application will in no case be refunded.
The consumer accepts that they have read and understood this article and signed the agreement knowing the risk of not receiving a visa.
3. In the situations specified in Article 2, material damages covered by insurance will be claimed from the relevant insurance company.
4. For discounted products purchased by the consumer during the discounted sales period of domestic hotels (domestic early booking campaigns), name and date changes, transfers, and cancellation requests are not accepted for any reason other than force majeure. In this case, the consumer accepts, declares, and undertakes to pay the full reservation fee to the travel agency as a cancellation penalty.
5. If the consumer does not notify the travel agency in writing that they will join a trip they missed the start of later, the travel agency has the right to cancel all reservations made on behalf of the consumer after 24 hours. No refund will be made to the consumer for such cancellations.
6. The consumer may transfer the package tour to a third party by notifying in writing or via a durable data storage medium up to 7 days before the start of the service. The transferee is jointly responsible with the transferor for the balance and expenses arising from the transfer. Visa fees will not be refunded to consumers whose visa process has been completed for transferred tours. Transferee consumers of package tours are responsible for their own visa obligations. Transfers are not accepted for promotional package tour sales.
7. Force Majeure: Adverse weather conditions, road blockades, strikes, terrorism, war, the possibility of war, and unforeseen technical matters that prevent the start or continuation of the trip are accepted by both parties as force majeure. Illnesses or deaths of the passenger or their first-degree relatives that prevent their normal activities for 10 days are also considered force majeure, provided there is an official board report obtained from a fully equipped state hospital.
8. Sales are made in cash or by bank credit cards in full and/or in installments through bank credit cards that offer installment options. For sales made by credit card, if payment is not made, the consumer is liable to their bank with which they signed the credit card agreement. In this case, the interest rates applied by the bank are valid, and the travel agency will not be a party to the matter.
9. If, after the performance of the contracted service, the credit card the consumer used to pay the contract fee is claimed to have been used unlawfully and illegally by unauthorized persons, and the bank or financial institution does not pay the service fee to the travel agency, the consumer will be liable for the disputed service fee and all damages, together with the statutory interest accruing from the reservation date.
III-GENERAL PROVISIONS
1. The consumer participating in the tour has the right to carry 2 suitcases not exceeding 50cm x 70cm in size for all trips, and 20kg of baggage on air travel. All responsibility for suitcases and their contents belongs to their owners.
2. All services included in the fee are specified in the package tour programs. Tours or services beyond these are subject to an extra fee. During reservation, two separate fees under the names of package tour fee and additional service fee are collected against a receipt. These fees also cover guiding fees.
3. Items that are odorous, leaking, flammable, or explosive, or that cause disturbance to surroundings, as well as bladed, piercing, and firearms, and all kinds of animals, will not be taken into vehicles or accommodation facilities of the travel agency without its separate, explicit, and written permission. Having identity or licenses does not change this.
4. In case of loss or damage to the consumer's baggage, if it arises from the gross fault of the travel agency personnel, the travel agency will pay the owner-consumer 1/2 of the portion of the total trip fee attributable to transportation as material and moral compensation for the lost or damaged baggage and items, regardless of the material and moral value and other characteristics of the items inside the lost or damaged baggage. The travel agency is responsible up to the transportation cost of the trip for any loss, damage, or theft of items that the consumer has declared in writing with their values and delivered. The travel agency will not be held responsible if the lost item includes the consumer's identity, passport, or other official documents.
5. The travel agency's possible tour cancellation notifications may be made individually to each consumer, or generally by announcement in the Turkish edition of a high-circulation newspaper. In this case, the notification obligation is deemed fulfilled.
6. The travel agency has the right to change hotel names, transportation vehicles, departure times, and departure locations within the scope of the trip, or to transfer the consumer to another agency, provided it adheres to the standards specified in the program and notifies the consumer. Tour programs provided during registration are sample programs. Prices may change depending on the dates on which extra tours specified in the tour programs will be organized and the number of participants. The consumer accepts that the trip conditions have been fulfilled if the number of overnight stays in the total trip duration is not shortened and there is no change in the class and category of the accommodation facilities.
7. If the travel agency is requested to follow visa procedures, the consumer must have a passport valid for at least six months and must apply to the travel agency within the documents and timeframe specified by the relevant consulate. The travel agency acts as an intermediary between the consumer and the consulate in visa procedures and is not responsible for visas not being obtained. If the visa is not approved by the consulate, the cancellation conditions stated above will apply.
8. The scope of coverage for incomplete or defective performance, damage, loss, and losses of consumers who purchase travel insurance services or are included in a travel insurance package is determined by the policy of the insurance company providing this service. The travel agency bears no responsibility regarding the content, scope, and application methods of these coverages.
9. On the arrival day at the hotel or ship, rooms may not be delivered to consumers before 14:00. On the departure day from the hotel, consumers must vacate their rooms by 12:00 at the latest. The standard of additional beds in triple rooms may vary according to the hotel.
10. The prices and conditions stipulated in the travel agency's package tour contract cannot be changed. This provision does not apply to price changes arising from other taxes and fees such as port and airport landing taxes, or from exchange rate fluctuations. However, price increases occurring before the package tour for the reasons given above will be notified to the consumer. In this case, the consumer has the right to withdraw from the contract without paying any compensation. Visa expenses, taxes, duties, and similar legal obligations that must be paid, amounts paid to third parties that can be documented, and insurance fees will not be refunded under any circumstances.
11. The travel agency is responsible for changes occurring after the start of the trip in the tour program purchased by the consumer. The travel agency may compensate the consumer for obvious changes that are to the consumer's detriment and cause them harm, either by refunding the fee or service in accordance with the provisions of the TÜRSAB KÜTAHYA SCHEDULE during or after the trip, and may also offer compensation through additional and/or alternative arrangements not included in the price and provided to the consumer during the trip. Acceptance or use of additional or substitute services by the consumer eliminates their fee refund and compensation rights.
12. If the consumer abandons the tour they started on the grounds that the service was defective, they are obliged to notify the travel agency's authorized person and the hotel where they are staying immediately in writing, together with the reasons. Otherwise, the consumer is not deemed to have abandoned the tour and is considered to have received and used the service. It is the duty of care of a good-faith consumer to notify the authorized person in writing during the performance of the service of matters they complain about.
13. The provisions of this agreement concluded between the travel agency and the consumer during registration have been read by the consumer. The consumer has been informed of all accommodation details of the facility from sources such as brochures, website, sales software, etc., and has signed while requesting and accepting that registrations be made under the same conditions on behalf of other persons they stated would join the same trip with them. The consumer accepts to pay any price difference arising from incorrect and/or incomplete voucher information they declared.
14. Consumer(s) who are not signatories to the agreement but who join the trip that is the subject of the agreement are deemed to have accepted and undertaken the agreement provisions upon the signing of this agreement by the consumer(s) they authorized to make registrations on their behalf. Nevertheless, if the consumer(s) who join the trip are sued or pursued against the travel agency on the grounds that they did not personally sign the agreement, or if the travel agency is forced to pay any fee or compensation to the consumer other than what is written in this agreement, the travel agency's right of recourse is reserved for any excess amount paid to the consumer(s) who are signatories to the agreement. Consumers joining this trip, even without signing, are deemed to have learned of the terms of this agreement, which will be valid between the parties, through the catalog and advertisements, and to have accepted and undertaken to join the trip under these agreement terms. Legal obligations are deemed fulfilled upon issuing a copy of this agreement in the name of the persons who will join/have joined the trip that is the subject of the agreement and providing a written copy to the consumer authorized to make the agreement. The agreement, voucher, and receipt sent by the agency to the consumer's fax, email, or other contact addresses must be signed by the consumer and sent back to the agency. If not sent back within 24 hours, they are deemed to have accepted and undertaken the provisions of this agreement. For cancellation insurance to be valid, this agreement must be signed by the consumer and sent to the agency.
15. The travel agency acts as an intermediary with the consumers joining the trip, hotels, transport companies, and all kinds of third parties and legal entities providing other trip-related services. Therefore, the parties are aware that the travel agency has no existing responsibility for any malfunctions arising from vehicles not being at the departure point at the times shown in their programs, contrary to agreements between the travel agency and the transport-undertaking institutions; any delays, breakdowns of land, air, and sea vehicles; fog, storms, snowstorms, and all kinds of weather conditions; road blockades; changes in route or itinerary; strikes, terrorism, the possibility of war, or similar force majeure events; errors by the vehicle driver or personal faults of third parties, or unforeseeable technical matters; material or moral damage accidents; deficient or erroneous services of accommodation facilities; or because the travel agency is not the operator.
16. Since all arrangements for charter flights are subject to international aviation rules, airlines under the Warsaw Convention may make any time changes to these flights. Departure times cannot be guaranteed. The carrier may change stopover points shown on tickets or may not make stopovers. As flight times are finalized 48 hours in advance, times specified at the time of sale are probable times, and the travel agency cannot be held responsible for changes in this regard. For this reason, cancellation and refund requests made due to these changes cannot be accepted.
17. All services included in the fee in tour programs are specified separately. Tours or services beyond these are subject to an extra fee. Local agencies in the cities or countries visited determine and propose the fees and contents of extra tours. These tours can only be held if sufficient participation is achieved, and no compensation and/or refund can be requested from the travel agency because extra tours are not held.
18. The travel agency is responsible for causes other than force majeure occurring after the start of the service it has committed to, situations for which the consumer is responsible, and personal responsibilities of third parties.
19. For matters not written in this agreement, the provisions of Law No. 1618, Law No. 6502, Law No. 2634, IATA, IHA, UFTAA conventions, the Civil Aviation Law, the Turkish Code of Obligations (TBK), the Turkish Commercial Code (TTK), international agreements to which Turkey is a party, and regulations, bylaws, circulars, and communiqués issued in connection with them, as well as the provisions of the TÜRSAB Kütahya Schedule applying the internationally recognized Frankfurter Tabelle in Turkey, shall apply. This voucher and package tour agreement, prepared in two copies between the parties, has been arranged on both sides with all its annexes, read, checked, and accepted by the authorized persons of the parties. The parties have confirmed and accepted the commitments and performances they mutually agreed upon by signing together. The travel agency also accepts and undertakes that the person who signed this voucher and agreement on behalf of the customers named in this agreement who will join the trip, as their proxy on behalf of the party, bears all legal responsibility.
20. For international and Cyprus flights, a notarized consent letter is mandatory for children under 18 who will not travel with both parents. Otherwise, the flight cannot be operated.
SERVICE DEFECT COMPLAINTS:
In case of defective or faulty service provision, the Arbitration Committee or Consumer Courts are authorized according to the monetary limits determined under the Law on Consumer Protection.
SERVICE GUARANTEE:
If there is sufficient participation and no force majeure, the travel agency accepts and undertakes, independently of the advertisements and published brochures issued about the trip, to fulfill the services it has committed to above, in return for the fee written above. If the travel agency partially or fully fails to fulfill its commitments written above, the refund amount to be paid to the customer shall be determined in accordance with the provisions of the TÜRSAB KÜTAHYA SCHEDULE.
