Cancellation and Refund Terms

I - PAYMENTS

A) At the time of registration, at least 35% of the reservation fee must be paid, and the remaining balance must be paid no later than 30 days before the start of the tour. If the specified payments are not made within these periods, the reservation will be cancelled, and 35% of the fee will be charged to the consumer as a cancellation penalty. 

B) A consumer who purchases discounted services is obligated to pay the full service fee on the reservation date.

C) For special products and services, the balance must be paid no later than 60 days before the start of the service. The cancellation penalty is the same as in clause I/A.

D) For day trips, the full tour fee is collected at the time of registration; there is no advance reservation.

 

II - CANCELLATION AND TRANSFER

1) Despite exercising all necessary diligence, the agency may cancel or postpone the tour if the required number of confirmed passengers does not materialize, preventing the start or continuation of the trip, and/or due to adverse weather conditions, road blockages, strikes, terrorism, fog, war, threat of war, unforeseeable technical issues, and all force majeure circumstances. In such cases, the consumer has no right to compensation. 

2) A) If the consumer requests cancellation up to 15 days before the start of the accommodation-based tour, the full amount paid will be refunded to them. 

B) If the consumer requests cancellation up to 15 days before the start of the service, the full amount paid will be refunded to them. However, if the consumer cancels the contract between 15 and 7 days before the start of the service, they accept and undertake to pay 35% of the tour fee to the agency; if cancellation occurs less than 7 days before the start, they accept and undertake to pay the full amount. Date changes made by the consumer are considered cancellations (Date changes are at the discretion of the company). 

C) In case of cancellation or transfer of discounted services, the consumer accepts and undertakes to pay 35% of the service fee if the cancellation occurs exactly 15-7 days before the service start, and the full service fee if it occurs less than 7 days before the start.

D) For cruise ship tours, the cancellation and refund terms of the shipping company apply. Accordingly; for cruise travel, after reservation confirmation, cancellations made up to 77 days before the trip incur a service fee of 100 Euro per reservation; cancellations between 76-60 days incur 25% of the reservation amount; 40% at 59-45 days; 60% at 44-31 days; 80% at 30-21 days; and 100% at 20-0 days. For air-inclusive packages, the airline's cancellation terms applicable to the status of the issued ticket will apply. 

E) Illnesses or deaths of the consumer or their first-degree relatives that prevent them from engaging in their usual occupation for 10 days, provided with an official committee report from a fully equipped state hospital submitted in writing before the start of the service, constitute an exception to the cancellation/transfer clauses.

3) The consumer may transfer the tour to another person of their choice up to exactly 7 days before the start of the service, subject to written notification to the agency. The transferee is jointly liable with the transferor for any outstanding balance and all expenses arising from the transfer.

4) If the consumer fails to notify the agency in writing that they will participate in the service after missing its start; the agency reserves the right to cancel all reservations and services made on behalf of the consumer 24 hours later. No refund of any fees will be made to the consumer in such cancellations.

5) The agency may partially or completely cancel advertised or registered tours before the start of the trip, subject to notifying the consumer when deemed necessary. Within the same period, the agency may change the names of hotels included in the tour, transportation vehicles and their departure points, as well as the visiting intervals of places shown in the program as destinations to be visited. 

6) In cases of flight cancellation and changes, airline conditions apply. Promotional tickets cannot be cancelled or changed. Promotional tickets are valid only together with hotel reservations. In case of hotel reservation cancellation, the full amount of the flight ticket will be deducted from the total payment.

7) Guests must be at the airport at least 1.5 hours before domestic flights and at least 2 hours before international flights. Presentation of an ID card is mandatory for domestic flights, and a passport is mandatory for international flights (Transactions are conducted based on the names indicated on these documents). Driver's licenses do not substitute for identification on flights.

8) For accommodation-based tours, the cancellation penalty 48 hours before the tour is the same as in clause II/1)A. Despite exercising all necessary diligence, the agency may cancel or postpone the tour if the required number of confirmed passengers does not materialize, preventing the start or continuation of the trip, and/or due to adverse weather conditions, road blockages, strikes, terrorism, fog, war, threat of war, unforeseeable technical issues, and all force majeure circumstances. In such cases, the consumer has no right to compensation. 

9) For day trips, the cancellation penalty 12 hours before the tour is the same as in clause II/1)A. Despite exercising all necessary diligence, the agency may cancel or postpone the tour if the required number of confirmed passengers does not materialize, preventing the start or continuation of the trip, and/or due to adverse weather conditions, road blockages, strikes, terrorism, fog, war, threat of war, unforeseeable technical issues, and all force majeure circumstances. In such cases, the consumer has no right to compensation. 

 

III - GENERAL PROVISIONS

1) All responsibility regarding luggage and its contents lies with the owner. The consumer is obliged to comply with the laws and regulations applicable to the vehicle they will travel in and the facility where they will stay.

2) In cases of baggage loss or damage caused by gross negligence of the provider; if the consumer has the provider issue a LOSS OR DAMAGE REPORT, regardless of the material and moral value and other characteristics of the items inside the baggage, half (1/2) of the portion of the total tour cost attributable to transportation will be paid by the agency to the consumer as the owner of the goods, as material and moral compensation for the lost item(s) and suitcase. The agency is liable for any loss, damage, or theft of declared items (declared in writing with their values), up to the amount of the tour's transportation fee.

3) VISA PROCEDURES and SERVICES are not included in the purchased service. If requested, the agency may assist guests with visa application procedures within the scope of the fee. Since the parties involved in visa procedures facilitated by the agency are directly the passenger and the consulate, the agency is not responsible for any problems that may arise.

4) The agency is responsible for reasons other than force majeure occurring after the start of the service, situations for which the consumer is responsible, and situations arising from the personal liability of third parties. In cases within the scope of the agency's liability, the consumer may be compensated either through a price or service refund in accordance with the provisions of the TÜRSAB Kütahya Table, or the agency may also resort to providing additional and/or alternative arrangements not included in the price during the tour. Acceptance and use of additional or substitute services by the consumer nullifies the right to a price refund and compensation.

5) The consumer accepts that they will comply with the rules communicated by the guide, facility, agency, and transportation vehicle authorities; that they will respect the life, property, and peace of third parties; and that failure to do so will result in the service being rightfully withheld, with no right to a refund.

6) If the consumer leaves the tour claiming the performed service was defective, they must notify the Agency Representative and the hotel where they stayed in writing, stating the reasons. Otherwise, the consumer will not be considered to have abandoned the tour and will be deemed to have received and used the service.

7) It is the duty of the consumer acting in good faith to cooperate and exercise diligence by reporting any complaints in writing to the Agency during the performance of the service.

8) Consumers who did not sign the contract but participated in the service covered by the contract are deemed to have accepted and undertaken the terms of this contract by having the consumer(s) they appointed to register in their name read and sign this contract. The agency reserves the right of recourse to collect any excess amount or service fee paid to the consumer(s) who signed the contract.

9) According to Article 12 of Law No. 1618; in case the package tour service is purchased, situations where the package tour is not provided at all or is provided incompletely are insured. The coverage limit is equal to the package tour fee.

10) For tours departing abroad, in accordance with the law, children under 18 years old traveling separately from their mother or father must obtain a notarized consent letter from the parent not accompanying the child and travel with this document.

11) The consumer has the right to withdraw from the contract by applying in writing to the agency within (7) days from the effective date of this contract for the performance of the contracted service for themselves or the person designated by them, and by submitting the original tour registration forms to the agency. The service fee will be refunded to the consumer within 10 days following the receipt of these documents. If the original invoice is not sent, VAT and other legal obligations will not be refunded.

12) In cases where the agency fails to comply with the contract in whole or in part, the provisions of the TÜRSAB KÜTAHYA TABLE will be applied for calculating the compensation to be paid.

13) The consumer declares that they have read and are informed about all preliminary information regarding the quality of the product/service, sales price, payment method, and performance related to the contract, and have provided the necessary confirmation electronically.
